I have been asked many times what are the estate planning essentials. They would be first, a Will. This document should be self proved. A Will can have a recommendation of guardianship for small children. The law says this is a “strong guide” for the Clerk of Court. A typical concern parents voice to me are “what if” scenarios. What if my spouse and I are in the car and hit a transfer truck head on? A Will should waive bond, can incorporate a pour over trust and do alot of other legal things. The second and third documents are really incapacity planning, but we do them at the same time the Will is executed. These are the General Durable Power of Attorney and Health Care Power of Attorney.
