Estate Planning Essentials

I have been asked many times what are the estate planning essentials.  They would be first, a Will.  This document should be self proved.  A Will can have a recommendation of guardianship for small children.  The law says this is a “strong guide” for the Clerk of Court. A typical concern parents voice to me are “what if” scenarios.  What if my spouse and I are in the car and hit a transfer truck head on? A Will should waive bond, can incorporate a pour over trust and do alot of other legal things. The second and third documents are really incapacity planning, but we do them at the same time the Will is executed. These are the General Durable Power of Attorney and Health Care Power of Attorney.

WHAT DOCTOR SHOULD AN INJURED EMPLOYEE SEE?

In workers’ compensation claims should injured employees have more choice in what doctors they can see? For the most part, the employer decides what doctors the employee sees.  Disagreements and requests for second opinions go before the Executive Secretary on a case by case basis.  The counterpoint employers make for choosing the doctor is the employer is footing the bill.  Should the employee have more choice?
